STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT granting immunity from liability to law enforcement officers executing involuntary emergency mental health admissions.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Involuntary Emergency Mental Health Admissions; Immunity From Liability. Amend RSA 135-C by inserting after section 29 the following new section:
135-C:29-a Immunity from Liability. A law enforcement officer acting in good faith pursuant to this chapter who takes reasonable steps to assess, take custody of, detain, or transport an individual for the purpose of mental health assessment or treatment shall be immune from civil and criminal liability.
2 Effective Date. This act shall take effect January 1, 2004.
