AN ACT relative to health care in certain health care facilities.

This bill authorizes a patient's personal representative to make health care requests on behalf of the patient if the patient is temporarily incapacitated due to anesthesia or other drugs after surgery.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT relative to health care in certain health care facilities.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Standard of Care in Heath Care Facilities. Amend RSA 151 by inserting after section 29 the following new section:
151:29-a Standard of Care in Health Care Facilities. A patient in a health care facility who is temporarily incapacitated due to anesthesia or other drugs resulting from surgery may designate the patient's personal representative to make health care requests on behalf of such patient for the period during which such anesthesia or drugs are in effect.
2 Effective Date. This act shall take effect January 1, 2004.
