HOUSE BILL 296
AN ACT relative to settlement agreements in medical malpractice suits.
ANALYSIS
This bill prohibits the enforcement of any portion of a settlement agreement in a medical injury action that prevents the disclosure of relevant information to the appropriate state medical licensing board.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT relative to settlement agreements in medical malpractice suits.
Be it Enacted by the Senate and House of Representatives in General Court convened:
195:1 New Section; Settlement Agreements; Nondisclosure. Amend RSA 507-E by inserting after section 2 the following new section:
507-E:3 Settlement Agreements. Any portion of a settlement agreement in an action for medical injury which has the purpose or effect of prohibiting disclosure of relevant information to the appropriate state medical licensing board is void, contrary to public policy, and shall not be enforced.
195:2 Effective Date. This act shall take effect January 1, 2004.
