HOUSE BILL 414
AN ACT requiring liquor liability insurance for state liquor licensees.
ANALYSIS

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT requiring liquor liability insurance for state liquor licensees.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Insurance for Liquor Liability. Amend the introductory paragraph of RSA 178:2-a, I to read as follows:
[If the commission finds that a licensee or applicant has twice within 24 months violated RSA 179:5 under circumstances not involving enforcement activity initiated solely for the purpose of verifying noncompliance with RSA 179:5,] The commission [may] shall require, as a condition of the issuance, renewal, or reinstatement of any license that the licensee or applicant furnish sufficient security for liquor liability of the licensee of up to a limit of [$100,000] $1,000,000 for any one person and [$300,000] $3,000,000 for all persons per incident. Such security may be provided by:
2 Repeal. The following are repealed:
I. 2002, 125:4, relative to applicability of liquor liability insurance requirement.
II. 2002, 125:5, relative to report by liquor commission on liquor liability insurance.
3 Effective Date. This act shall take effect 60 days after its passage.
