HOUSE BILL 435
AN ACT relative to certificates of registration upon transfer of a vehicle.
ANALYSIS
This bill requires the person in whose name a vehicle is registered to retain the expired certificate of registration upon transfer of a vehicle. Current law requires the return of the certificate to the department of safety.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT relative to certificates of registration upon transfer of a vehicle.
Be it Enacted by the Senate and House of Representatives in General Court convened:
48:1 Registration of Vehicles; Transfer of Ownership; Expired Certificate. Amend RSA 261:66, I to read as follows:
I. Upon the transfer of ownership of any vehicle, its registration shall expire[, and the person in whose name such vehicle is registered shall return the certificate of registration forthwith to the department, with a written notice containing the date of such transfer of ownership and the name, residence, and address of the new owner, or, in case of total loss by fire, theft, or accident, a sworn statement setting forth all the circumstances attending such loss]. The person in whose name such vehicle is registered shall retain the expired certificate of registration in order to obtain transfer credit, if applicable. The decease of the owner shall not terminate such registration unless there [be] is an actual transfer of ownership.
48:2 Effective Date. This act shall take effect 60 days after its passage.
