HOUSE BILL 484

AN ACT providing immunity for law enforcement officers who participate in state mentoring programs.

ANALYSIS

This bill provides that law enforcement personnel participating in the department of safety's mentoring program, or any other state-sponsored mentoring program, who are acting in their official capacity as mentors and engaging in age-appropriate mentoring activities, shall not be civilly or criminally liable for acts or omissions during such mentoring, unless such acts or omissions are reckless or purposeful in nature.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT providing immunity for law enforcement officers who participate in state mentoring programs.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Department of Safety; Mentoring Program Participants. Amend RSA 21-P by inserting after section 15-a the following new section:

21-P:15-b Limited Liability for Participation in Mentoring Program. Law enforcement personnel participating in the department of safety's mentoring program, or any other state-sponsored mentoring program, who are acting in their official capacity as mentor and engaging in age-appropriate mentoring activities, shall not be civilly or criminally liable for acts or omissions during such mentoring, unless such acts or omissions are reckless or purposeful in nature.

2 Effective Date. This act shall take effect January 1, 2004.
