AN ACT relative to innovative land use controls.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT relative to innovative land use controls.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subparagraph; Land Use Planning; Impact Fees. Amend RSA 674:21, V by inserting after subparagraph (i) the following new subparagraph:

(j) The failure to adopt an impact fee ordinance shall not preclude a municipality from collecting fees from developers to meet capital improvement needs necessitated by developments. Such needs shall include any necessary road drainage, and sewer and water upgrades pertinent to that development.

2 Effective Date. This act shall take effect 60 days after its passage.
