AN ACT relative to the application of statutes, and rules or ordinances authorized by statutes.

ANALYSIS

This bill provides that the application of statutes, and rules or ordinances authorized by statutes, shall not prohibit or be contrary to the rights granted by the constitution.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT relative to the application of statutes, and rules or ordinances authorized by statutes.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Statutory Construction; Application; Constitutional Rights. Amend RSA 21:1 to read as follows:

21:1 Application. In the construction of all statutes and any administrative rules or local ordinances or regulations authorized by a statute, no application shall prohibit or be contrary to the rights granted in the state constitution or the federal constitution. In addition, the following rules shall be observed, unless such construction would be inconsistent with the manifest intent of the legislature or repugnant to the context of the same statute.

2 Effective Date. This act shall take effect 60 days after its passage
