HOUSE BILL 508

AN ACT relative to participation of insured defendants in superior court mediations.

ANALYSIS

This bill provides that insured defendants are not required to be in attendance for superior court mediations and other alternative dispute resolution proceedings in which the defendant is represented by the insurance company.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT relative to participation of insured defendants in superior court mediations.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Superior Court Mediations. Amend RSA 507 by inserting after section 16 the following new subdivision:

Superior Court Mediations

507:17 Participation of Insured Defendant Not Required. An insured defendant who is represented by the insurance company shall not be required to personally attend a mediation proceeding or other alternative dispute resolution proceeding in superior court.

2 Effective Date. This act shall take effect January 1, 2004.
