HOUSE BILL 1126
AN ACT relative to obstructing or hindering hunting, fishing, or trapping of fish and game.
ANALYSIS
This bill extends the prohibition on obstructing or impeding the hunting, fishing, or trapping of fish and game to all land on which hunting is permitted.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT relative to obstructing or hindering hunting, fishing, or trapping of fish and game.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Interference with Hunting, Fishing or Trapping; Application Extended; Definition Added. Amend RSA 207:57, I to read as follows:
I. No person shall purposely obstruct or impede the participation of any individual in the lawful activity of hunting, fishing, or trapping while that individual is in a designated hunting area [on public lands]. No person shall enter or remain in a designated hunting area on any [state lands] property with the intent to purposely obstruct or impede the participation of any individual in the lawful activity of hunting, fishing, or trapping.
I-a. For purposes of this section, "purposely obstruct or impede" shall include:
(a) Placing one's self in a location in which human presence may alter the behavior of the fish or game that another person is attempting to take;
(b) Altering the feasibility of taking fish or game by another person; or
(c) Creating a visual, aural, olfactory, or physical stimulus in order to alter the behavior of the fish or game that another person is attempting to take.
2 Effective Date. This act shall take effect January 1, 2005.
