AN ACT relative to tort liability to third persons for oil spills.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT relative to tort liability to third persons for oil spills.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Tort Liability to Third Persons; Actual Damages. Amend RSA 146-A:10 to read as follows:

146-A:10 Tort Liability to Third Persons. Any person who negligently or intentionally discharges or spills oil into or on the waters of any lake, pond, river, stream, or into tidal waters or into the groundwater of the state which causes damage to the property of another shall be liable in tort for actual damages to the person whose property is so damaged [in the amount of 1-1/2 times the damages sustained by that person].

2 Effective Date. This act shall take effect January 1, 2005.
