HOUSE BILL 1176
AN ACT relative to government access to private property.

This bill prohibits entry on private property by a public official absent a lawfully issued search warrant or the prior consent of the landowner.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT relative to government access to private property.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Chapter; Entry on Private Property. Amend RSA by inserting after chapter 7-B the following new chapter:
CHAPTER 7-C
ENTRY ON PRIVATE PROPERTY
7-C:1 Entry on Private Property. Absent a lawfully issued search warrant, no state, county, municipal, or other public official shall go onto any private property for any purpose without the prior consent of the landowner.
2 Effective Date. This act shall take effect 60 days after its passage.
