AN ACT relative to the formula for determining education grants and establishing education grant amounts for the 2005 fiscal year.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Statement of Intent. It is the intent of the general court to clarify the law relating to education funding as enacted under 2003, 241 and to specify education aid grant amounts to municipalities for the 2005 fiscal year.
2 Education Aid Grant Amounts for Fiscal Year 2005. Notwithstanding any provision of law to the contrary, total education aid grant amounts for the 2005 fiscal year shall be as follows:

3 School Money; Distribution of Education Grants. Amend RSA 198:42, II to read as follows:
II. For the fiscal year beginning July 1, 1999, and every fiscal year thereafter the amount necessary to fund the grants under RSA [198:40-c] 198:41 is hereby appropriated from the education trust fund created under RSA 198:39 to the department of education [according to the following formula: from the amount calculated in accordance with RSA 198:40-c, subtract the aggregate amount of the statewide enhanced education tax warrants to be issued by the commissioner of revenue administration for municipalities reported pursuant to RSA 76:9 for the next tax year]. The governor is authorized to draw a warrant from the education trust fund to satisfy the state’s obligation under this section. Such warrant for payment shall be issued regardless of the balance of funds available in the education trust fund. If the balance in the education trust fund, after the issuance of any such warrant, is less than zero, the commissioner of the department of administrative services shall inform the fiscal committee and the governor and council of such balance. This reporting shall not in any way prohibit or delay the distribution of education grants.
4 Effective Date. This act shall take effect July 1, 2004 at 12:01 a.m.

HB 1188 FISCAL NOTE
AN ACT relative to indoor air quality and indoor environmental standards in public schools and requiring public schools to develop a written building maintenance plan.
FISCAL IMPACT:
The Department of Education indicates this bill, as amended by the House (Amendment #2004-0572h), will increase state general fund expenditures, local revenue and local expenditures by an indeterminable amount in FY 2007 and each year thereafter. There will be no fiscal impact on state and county revenue or county expenditures.
METHODOLOGY:
This bill provides for additional building aid to be paid by the state to local school districts in an amount equal to 1.5% of the total construction costs. The aid will be paid over the life of the bonds used to finance construction. In order for the school districts to be eligible for the aid, the construction projects must comply with indoor air quality and environmental standards outlined in this bill. This bill also limits the amount of additional building aid that can be awarded in any fiscal year to $100,000. The additional building aid program will be repealed effective July 1, 2011. The Department made the following assumptions when attempting to determine the fiscal impact of this bill:
• This bill will not affect the number of construction projects approved each year.
• This bill will not affect the manner in which building aid is distributed.
• The earliest that a project can qualify for the additional aid is FY 2007.
• The cost to comply with the standards addressed in this bill is an additional 2.5% of total construction costs.
• The cost to the local school districts to comply with the standards will equal the amount of aid received under the terms of this bill.
• The Department will pay the additional grant equally over the life of the bonds used to finance the project. The maximum amount that can be awarded each year, $100,000, is assumed to be the amount that can be paid in any one year, and not the amount to be paid over the life of the loan. Thus, the amount paid out in FY 2011 could be a maximum of $500,000. That amount, or a lesser one, would continue to be paid by the state to the school districts until the end of the term of all the bonds.
The Department states it cannot predict the number and cost of projects that will comply with the standards contained in this bill.
