STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT relative to leasing a certain parcel of state-owned property to the town of Hopkinton.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Conveyance of State-Owned Real Estate. Notwithstanding RSA 4:40, the commissioner of the department of transportation shall lease for 99 years a 5.7 acre parcel of state-owned real estate identified as tax map 222, lot 78 located on the westerly side of route 103 in Hopkinton, to the town of Hopkinton for the sum of $1.
2 Effective Date. This act shall take effect upon its passage.

AN ACT relative to leasing a certain parcel of state-owned property to the town of Hopkinton.
FISCAL IMPACT:
The Department of Transportation indicates this bill will increase state unrestricted revenue and local expenditures by $1 in FY 2004. There is no fiscal impact on county and local revenue or state and county expenditures.
METHODOLOGY:
The Department states that this bill directs the Commissioner of the Department of Transportation to lease a 5.7 acre parcel of state-owned property for 99 years to the Town of Hopkinton for $1. The Department, at the request of an abutter, began the process to sell this parcel. The process to sell state-owned property is detailed in RSA 4:40. As part of that process, municipalities are offered surplus property prior to the sale to the general public. When the Town of Hopkinton was notified of this potential sale, the town expressed an interest to purchase this parcel for athletic fields. The Department entered into an encroachment agreement with the town that would allow the use of this land for athletic fields while the sale went through the RSA 4:40 procedures. As part of those procedures, the parcel was appraised to determine fair market value, which would be the basis for the selling price. The appraisal came in at $90,000, was reviewed, and reduced to $83,000. The Department believes this is the low end of the parcel's fair market value and if the parcel were sold to the public it would demand a selling price of at least $83,000. Based on the fair market value appraisal, the Department believes that by leasing this parcel for $1 over 99 years, the state will lose $83,000, the fair market value of the parcel.
