AN ACT relative to standards of certification in credentialing for New Hampshire public school food service directors and staff.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT relative to standards of certification in credentialing for New Hampshire public school food service directors and staff.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Food Service Personnel. Amend RSA 21-N:7 by inserting after paragraph VI the following new paragraph:

VII. Administering standards for certifying and recertifying food service personnel, including monitoring local staff development efforts.

2 New Subparagraph; Rulemaking; Food Service. Amend RSA 21-N:9, II by inserting after subparagraph (bb) the following new subparagraph:

(cc) Certification standards for school food service personnel under RSA 189:11-c.

3 New Section; Food Service Personnel. Amend RSA 189 by inserting after section 11-b the following new section:

189:11-c Food Service Personnel Certification. Public school food service personnel shall acquire food service certifications from the American Culinary Federation, the American Dietetic Association, the American Food Service Association, or the Dietary Managers Program, National Restaurant Association, as follows:

I. No later than one year after their date of employment, all food service employees in public schools shall be required to complete a sanitation course.

II.(a) No later than 3 years after the date of employment, the director or manager of a single facility shall acquire certification in the following topics:

(1) Child nutrition.

(2) Operations.

(3) Financial management.

(4) Marketing.

(b) The director or manager shall acquire recertification every 3 years after initial certification. Recertification shall consist of a total of 120 hours of continuing education with 90 hours in the categories referenced in subparagraph (a).

III.(a) No later than 5 years after the date of employment, the director of multiple facilities shall acquire certification in the following topics:

(1) Child nutrition.

(2) Operations.

(3) Financial management.

(4) Marketing.

(b) The director shall acquire recertification every 3 years after initial certification. Recertification shall consist of a total of 195 hours of continuing education with 150 hours in the categories referenced in subparagraph (a).

4 Applicability. For the purpose of this act, the time period allocated for initial certification of those employed as public school food service personnel as of the effective date of this act, shall begin on the effective date of this act.

5 Effective Date. This act shall take effect 60 days after its passage.
