AN ACT relative to seasonal directional signs.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT relative to seasonal directional signs.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Definitions; "Seasonal Directional Signs." Amend RSA 236:70 by inserting after paragraph XIX the following new paragraph:

XX. The words "seasonal directional signs" shall mean business directional signs established as official signs to provide directional information for eligible motorist-oriented privately owned businesses which provide services for a continuous period of 3 months but less than 12 months during each year. Seasonal directional signs shall include a symbol or other easily identifiable designation to indicate the season during which the business operates and may include the word "seasonal." Seasonal directional signs shall be displayed throughout the year in the same manner as other business directional signs.

2 Restriction of Advertising; Seasonal Businesses. Amend RSA 236:73, IV(b) to read as follows:

(b) Off the right-of-way as may be permitted under rules adopted by the commissioner of transportation. Such signs may include signs directing the traveling public to privately owned seasonal or year-round resorts, hotels, restaurants or other commercial establishments catering to the traveling public where the commissioner of transportation determines that such a sign is necessary to the continued operation of such commercial establishment and that traffic safety is best served by providing such a sign to the traveling public thereby avoiding confusion on the part of the motorist. Any such directional or seasonal directional sign shall be erected and maintained by the commercial establishment involved under rules adopted by the commissioner, and which conform to national standards as promulgated by the Secretary of Transportation; or

3 Effective Date. This act shall take effect 60 days after its passage.
