HOUSE BILL 1244
AN ACT relative to subcontractors' liens for labor and materials.
ANALYSIS
This bill provides that a bona fide purchaser for value who acquires real property, in good faith and without notice of liens, shall not be subject to a statutory lien for nonpayment for labor and materials when the nonpayment arose prior to the purchase.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT relative to subcontractors' liens for labor and materials.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Liens for Labor and Materials; Attachments on Real Property. Amend RSA 447:10 to read as follows:
447:10 How Secured. Any such lien may be secured by attachment of the property upon which it exists at any time while the lien continues, the writ and return thereon distinctly expressing that purpose. A bona fide purchaser for value who acquires real property in good faith and without notice of liens shall not be subject to an attachment on the property for nonpayment for labor and materials when the nonpayment arose before his or her purchase.
2 Effective Date. This act shall take effect January 1, 2005.
