AN ACT requiring the posting of notice by uninsured liquor licensees.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT requiring the posting of notice by uninsured liquor licensees.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Liquor Licenses and Fees; Notice of Lack of Insurance. Amend RSA 178 by inserting after section 2-a the following new section:

178:2-b Notice of Lack of Insurance.

I. At any time when a licensee does not have in effect liquor liability insurance, the licensee shall post notice of the lack of insurance on the premises.

II. The commission shall adopt rules, pursuant to RSA 541-A, relative to the placement and wording of the notice required by paragraph I.

2 Effective Date. This act shall take effect January 1, 2005.

HB 1252-FN - FISCAL NOTE

AN ACT requiring the posting of notice by uninsured liquor licensees.

FISCAL IMPACT:

The Liquor Commission states this bill will have an indeterminable fiscal impact on state general fund revenue and expenditures in FY 2004 and each year thereafter. There will be no fiscal impact on county and local revenue or expenditures.

METHODOLOGY:

The Commission states there will be mailing costs estimated at $3,108 annually to notice all existing and new licensees regarding the details of this law. The bill also requires at least one annual inspection of uninsured liquor licenses, and in some cases more than one visual inspection may be required to ensure notices are posted in public view. The Commission currently has the ability to inspect each licensee once per year, and any additional inspections required by this bill can possibly be performed by the current team of investigators and licensing specialists. Follow-up inspections, travel and other related expensed cannot be determined at this time. The increase in revenue can not be determined since it is unknown how many licensees will be fined for not posting a notice of lack of insurance on the premises.
