STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Four
AN ACT establishing a commission to study ways to encourage municipal recycling efforts and to study the tax exemption for water and air pollution control facilities.
Be it Enacted by the Senate and House of Representatives in General Court convened:
208:1 Commission Established. There is established a commission to study ways to encourage municipal recycling efforts and to study the tax exemption for water and air pollution control facilities under RSA 72:12-a.
208:2 Membership and Compensation.
I. The members of the commission shall be as follows:
(a) Four members of the house of representatives, appointed by the speaker of the house.
(b) Four members of the senate, appointed by the president of the senate.
(c) The commissioner of the department of environmental services, or designee.
(d) A member nominated by New Hampshire the Beautiful, Inc. and appointed by the governor.
(e) A member nominated by the Northeast Resource Recovery Association and appointed by the governor.
(f) Two public members, appointed by the speaker of the house of representatives.
II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.
208:3 Duties. The commission shall study:
I. Ways to enhance municipal recycling efforts.
II. Other systems for recycling currently used in the United States and Canada.
III. An environmental fee on recyclable household waste.
IV. The creation of a grant program and a fund to be used to help towns implement and expand recycling programs.
V. The use and impact of exemptions granted under RSA 72:12-a.
VI. How privately-owned landfills are assessed for tax purposes.
208:4 Chairperson; Quorum. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section.
208:5 Report. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the senate president, the house clerk, the senate clerk, the governor, and the state library on or before November 30, 2004.
208:6 Effective Date. This act shall take effect upon its passage.
