HOUSE BILL 1280-FN

AN ACT establishing limited driving privileges special licenses.

ANALYSIS

This bill establishes limited driving privileges special licenses for persons whose licenses have been suspended for reasons other than commission of a serious traffic offense or a finding that the person is an habitual offender. A limited driving privileges special license shall be valid only for driving from home to work and from work to home.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT establishing limited driving privileges special licenses.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Driver's License Suspension and Revocation; Limited Driving Privileges Special Licenses. Amend RSA 263 by inserting after section 53 the following new section:

263:53-a Limited Driving Privileges Special Licenses.

I. The director may, in his or her discretion, issue a limited driving privileges special license to a person whose license has been suspended for reasons other than commission of a serious traffic offense under RSA 265:79 through RSA 265:93 or a finding that the person is an habitual offender.

II. A limited driving privileges special license shall be valid only for driving from home to work and from work to home.

III. An application for a limited driving privileges special license shall include:

(a) A fee of $50.

(b) An affidavit including the routes that the person must travel between home and work.

(c) Any other information required by the director.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 1280-FN - FISCAL NOTE

AN ACT establishing limited driving privileges special licenses.

FISCAL IMPACT:

The Department of Safety states this bill will have an indeterminable fiscal impact on state revenue and expenditures in FY 2004 and each year thereafter. There will be no fiscal impact on county and local revenue or expenditures.

METHODOLOGY:

The Department states this bill establishes limited driving privileges special licenses. The Department does not know how many individuals may qualify for this license or how much it would cost to produce these licenses, and therefore, cannot estimate the fiscal impact on state revenues or expenditures at this time.
