HOUSE BILL 1284

AN ACT relative to setbacks from wetlands.

ANALYSIS

This bill requires the department of environmental services to define a wetland and to establish minimum setbacks from wetlands. Municipalities may not enact standards that differ from those of the department.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT relative to setbacks from wetlands.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Administrative Provisions; Wetlands; Definition and Setbacks. Amend RSA 482-A:11, I to read as follows:

I. The commissioner shall adopt reasonable rules, pursuant to the rulemaking provisions of RSA 541-A, to implement the purposes of this chapter. The rules shall define "wetland" and shall establish minimum setbacks for activities conducted near wetlands. Municipalities shall not enact standards that are more stringent than those of the department.

2 Effective Date. This act shall take effect 60 days after its passage.
