HOUSE BILL 1286

AN ACT relative to oaths of office.

ANALYSIS

This bill requires every town and state officer and employee involved in the preparation or enforcement of state laws or local ordinances to subscribe to the oath in part 2, article 84 of the constitution.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT relative to oaths of office.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Oath Required; State Employees. Amend RSA 92:2 to read as follows:

92:2 Oath Required. No person chosen or appointed to any public office or to any position where an oath is required, under any law, shall exercise such office or position or perform any act therein until he shall make and subscribe the oath or declaration as prescribed by part 2, article 84 of the constitution of New Hampshire, and any such person who violates said oath after taking the same shall be forthwith dismissed from the office or position involved. An oath shall be required from each employee involved in the preparation or enforcement of state laws.

2 Oath Required; Town Employees. Amend RSA 42:1 to read as follows:

42:1 Oath Required. Every town officer and every employee of a town who prepares or enforces state laws or local ordinances shall make and subscribe the oath or declaration as prescribed by part 2, article 84 of the constitution of New Hampshire and any such person who violates said oath after taking the same shall be forthwith dismissed from the office involved.

3 Effective Date. This act shall take effect 60 days after its passage.
