HOUSE BILL 1357

AN ACT relative to cluster zoning and the village plan alternative.

This bill requires any municipality that has adopted a zoning ordinance which includes cluster development to also offer the village plan alternative.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT relative to cluster zoning and the village plan alternative.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Innovative Land Use Controls; Cluster Development and Village Plan Alternative. Amend RSA 674:21, I to read as follows:

I. Innovative land use controls may include, but are not limited to:

(a) Timing incentives.

(b) Phased development.

(c) Intensity and use incentive.

(d) Transfer of development rights.

(e) Planned unit development.

(f) Cluster development and village plan alternative subdivision.

(g) Impact zoning.

(h) Performance standards.

(i) Flexible and discretionary zoning.

(j) Environmental characteristics zoning.

(k) Inclusionary zoning.

(l) Accessory dwelling unit standards.

(m) Impact fees.

[(n) Village plan alternative subdivision.]

2 New Paragraph; Cluster Development; Village Plan Alternative Included. Amend RSA 674:21 by inserting after paragraph V the following new paragraph:

V-a. Cluster development shall include the village plan alternative and, notwithstanding paragraph III, any municipality which has adopted cluster development shall also make available the village plan alternative, as described in paragraph VI. The land use control regulations shall allow the property owner the choice between cluster development or the village plan alternative.

3 Effective Date. This act shall take effect January 1, 2005.
