AN ACT relative to boating on certain lakes and ponds by disabled persons.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT relative to boating on certain lakes and ponds by disabled persons.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Restrictions on Boating; Disabled Exempt Operation. Amend RSA 270 by inserting after section 75 the following new section:
270:75-a Disabled Exempt Operation. No prohibition of or restriction on the use of motorboats established in this subdivision shall apply to disabled exempt operation of a boat that is powered by an electric motor and that has a disabled exempt operation endorsement on its registration certificate. Disabled exempt operation shall be limited to operation of the boat for purposes of fishing by a disabled person referenced in the endorsement.
2 New Paragraph; Vessel Registration Required; Disabled Exempt Operation Endorsement. Amend RSA 270-E:3 by inserting after paragraph IX the following new paragraph:
X. A person may obtain a disabled exempt operation endorsement on a registration certificate by providing proof of eligibility with the application for registration. Proof of eligibility shall be either verification that the disabled person has been issued a valid walking disability plate or placard under RSA 261:88 or documentation that would constitute satisfactory proof of a walking disability under RSA 261:88. The endorsement shall read: "This vessel is registered for disabled exempt operation if (name of disabled person or persons) is on board the vessel with a valid fishing license." The applicant shall provide separate proof of eligibility for each disabled person to be named in the endorsement.
3 Effective Date. This act shall take effect January 1, 2005.
