STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Four
AN ACT establishing the telecommunications planning and development fund.
Be it Enacted by the Senate and House of Representatives in General Court convened:
185:1 New Subparagraph; General Revenue Exceptions; Telecommunications Planning and Development Fund. Amend RSA 6:12, I(b) by inserting after subparagraph (227) the following new subparagraph:
(228) Moneys deposited in the telecommunications planning and development fund established by RSA 12-A:45-a.
185:2 New Section; Telecommunications Planning and Development Fund. Amend RSA 12-A by inserting after section 45 the following new section:
12-A:45-a Telecommunications Planning and Development Fund. There is hereby established in the office of the state treasurer a fund to be known as the telecommunications planning and development fund. The commissioner of resources and economic development is authorized to accept public sector and private sector grants, gifts, or donations of any kind for the purpose of funding initiatives associated with the purpose of this subdivision. Such grants, gifts, and donations shall be deposited in the telecommunications planning and development fund and may only be expended by the commissioner of resources and economic development to accomplish the purposes of this subdivision. The state treasurer may invest moneys in the fund as provided by law, with interest received on such investment credited to the fund. The moneys in this fund shall be nonlapsing and shall be continually appropriated to the department of resources and economic development.
185:3 Transfer of Appropriations. Any net unexpended appropriations for the telecommunications initiative under 2003, 318:03, 03, 02, 06 for fiscal year 2004 shall be transferred at the end of fiscal year 2004 to the telecommunications planning and development fund established by RSA 12-A:45-a.
185:4 Repeal. RSA 6:12, I(b)(228), relative to the telecommunications planning and development fund, is repealed.
185:5 Effective Date.
I. Section 4 of this act shall take effect July 1, 2008.
II. The remainder of this act shall take effect upon its passage.
