STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT granting limited law enforcement authority to certain federal officers stationed in New Hampshire.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Police Officers and Watchmen; Extended Authority for Federal Officers. Amend RSA 105 by inserting after section 13-b the following new section:
105:13-c Extended Authority; Federal Officers. A duly authorized law enforcement officer employed by the Federal Bureau of Investigation, the Drug Enforcement Agency, the United States Secret Service, or the United States Border Patrol shall, when assigned to duty in New Hampshire, have the authority to enforce state criminal and motor vehicle statutes to the extent necessary to render assistance to any state, county, or local law enforcement officer, or to a citizen who requests police assistance, where no other law enforcement officer with jurisdiction is present. The supervisory authority of any federal agency to which this section applies shall ensure that any federal officer who may exercise the authority granted in this section receives training in state statutory and constitutional law as may be determined by the director of police standards and training.
2 Effective Date. This act shall take effect January 1, 2005.
