AN ACT relative to the disclosure of protected health information by court ordered service providers.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT relative to the disclosure of protected health information by court ordered service providers.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Chapter; Court-Ordered Rehabilitation Assessment or Treatment Program. Amend RSA by inserting after chapter 546-B the following new chapter:
CHAPTER 546-C
COURT-ORDERED REHABILITATION ASSESSMENT OR TREATMENT PROGRAM
546-C:1 Court-Ordered Rehabilitation Assessment or Treatment Program; Disclosure of Protected Health Information. If a person is ordered by a court to participate in a rehabilitation assessment or treatment program, the entity that provides the service may disclose protected health information, as defined in the Health Insurance Portability and Accountability Act of 1996, P.L. 104-191, with the written consent or authorization of the person receiving the service or as expressly authorized by the court, in accordance with 45 C.F.R. Section 164.512(e)(1)(i). Information disclosed under this section shall be limited to that which is reasonably necessary to accomplish the purpose for which disclosure is sought. This section shall apply regardless of whether the person or the state pays for the services rendered.
2 Effective Date. This act shall take effect January 1, 2005.
