STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Four

AN ACT establishing a commission to study issues regarding the women’s prison facility.

Be it Enacted by the Senate and House of Representatives in General Court convened:

67:1 Commission Established. There is established a commission to study issues regarding the women’s prison facility.

67:2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) Three members of the house of representatives, at least one of whom shall be a member of the criminal justice and public safety committee and at least one of whom shall be a member of the public works and highways committee, appointed by the speaker of the house.

(b) One member of the senate, appointed by the president of the senate.

(c) The commissioner of the department of corrections, or designee.

(d) The commissioner of the department of transportation, or designee.

(e) One member who has expertise in issues regarding prison facilities, appointed by the governor.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

67:3 Duties. The commission shall study the adequacy of the current women’s prison facility in Goffstown and make recommendations on whether to renew the current lease on such facility. The commission shall investigate and make recommendations on the feasibility and cost of renovating a state-owned building as a women’s prison facility and any other options for a women’s prison facility which would be an alternative to the current facility in Goffstown.

4 Chairperson; Quorum. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Four members of the commission shall constitute a quorum.

67:5 Report. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the senate president, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2004.

67:6 Effective Date. This act shall take effect upon its passage.
