HOUSE BILL 1422

AN ACT relative to qualifications for persons who negotiate on behalf of the state.

AMENDED ANALYSIS

This bill prohibits the official state negotiator and members of the state negotiating committee from having a direct personal and pecuniary interest in the negotiation.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Four

AN ACT relative to qualifications for persons who negotiate on behalf of the state.

Be it Enacted by the Senate and House of Representatives in General Court convened:

137:1 New Paragraph; Public Employee Labor Relations; Bargaining by State Employees; Conflict of Interest. Amend RSA 273-A:9 by inserting after paragraph III the following new paragraph:

III-a. No person who is appointed to serve as a state negotiator or as a member of the state negotiating team or any person who serves as a member of the employee bargaining committee shall use his or her position to obtain anything of value for the private benefit of such person or the person’s immediate family. Nothing in this section shall prevent an employee or taxpayer from serving on a negotiating team or bargaining committee.

137:2 Effective Date. This act shall take effect 60 days after its passage.
