HOUSE BILL 152

AN ACT relative to regulation by political subdivisions of OHRV trails and exempting certain rail trails use from the state trail evaluation process.

ANALYSIS

This bill prohibits political subdivisions from regulating OHRV use of public trails authorized by landowner permission. The bill also exempts a change in use of state rail trails to include ATVs and trail bikes from the state trail evaluation process.

This bill was recommended by the study committee established by 2001, 259 (HB 717).

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT relative to regulation by political subdivisions of OHRV trails and exempting certain rail trails use from the state trail evaluation process.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Off Highway Recreational Vehicles; Regulation by Political Subdivisions. Amend RSA 215-A:15 by inserting after paragraph I the following new paragraph:

I-a. Towns and cities shall not have the authority to regulate landowner permission for public OHRV trail use and trail development given to OHRV clubs or to the chief of the bureau of trails provided such permission, use, and development are in compliance with this chapter.

2 New Paragraph; State Rail Trails Use Exempted. Amend RSA 215-A:43 by inserting after paragraph IV the following new paragraph:

V. This section shall not apply to the change in use designation of rail trails to include ATV and trail bike use.

3 Effective Date. This act shall take effect 60 days after its passage.
