AN ACT relative to the notice of proposed rulemaking under the administrative procedure act.
ANALYSIS
This bill requires a notice of proposed rulemaking under the administrative procedure act to include a statement that the proposed rule does not violate any section of the New Hampshire constitution, including but not limited to part I, article 28-a, relative to unfunded mandates.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT relative to the notice of proposed rulemaking under the administrative procedure act.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Administrative Procedure Act; Procedure for Adoption of Rules; Constitutionality Requirement. Amend RSA 541-A:3, I to read as follows:
I. Filing a notice of the proposed rule under RSA 541-A:6, including a fiscal impact statement and a statement that the proposed rule does not violate any provision of the New Hampshire constitution, including but not limited to part I, article 28-a;
2 Administrative Procedure Act; Notice of Rulemaking Proceedings; Constitutionality Requirement. Amend RSA 541-A:6, I(j) to read as follows:
(j) A statement, with adequate details and supporting data, that the proposed rule does not violate any provision of the New Hampshire constitution, including but not limited to part I, article 28-a.
3 Effective Date. This act shall take effect 60 days after its passage.
