STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT requiring youth bicyclists to wear protective headgear.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Commissioner of Health and Human Services; Rules; Protective Headgear. Amend RSA 126-A:5 by inserting after paragraph XII the following new paragraph:
XIII. The commissioner shall adopt rules pursuant to RSA 541-A relative to approved headgear required by RSA 265:144, X.
2 New Paragraph; Riding on Bicycles; Headgear. Amend RSA 265:144 by inserting after paragraph IX the following new paragraph:
X. No person less than 16 years of age may operate or ride upon a bicycle unless he or she wears protective headgear of a type approved by the commissioner of health and human services.
3 Effective Date. This act shall take effect 60 days after its passage.
