HOUSE BILL 385

AN ACT requiring compliance with local ordinances in the establishment of public ATV and trail bike trails on private lands.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT requiring compliance with local ordinances in the establishment of public ATV and trail bike trails on private lands.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 ATV and Trail Bike Operation on State Lands; Intent. Amend RSA 215-A:41, II(a) to read as follows:

(a) Uses, to the greatest extent possible, private lands, under voluntary agreement with landowners provided there is compliance with local ordinances and bylaws;

2 New Paragraph; ATV and Trail Bike Trails; Local Ordinances. Amend RSA 215-A:42 by inserting after paragraph I the following new paragraph:

I-a. Portions of ATV and trail bike trails which use private lands pursuant to landowner permission shall comply with local ordinances and bylaws.

3 Effective Date. This act shall take effect 60 days after its passage.
