HOUSE BILL 545

AN ACT requiring building contractors to disclose the name of any subcontractors involved in the project.

ANALYSIS

This bill requires building contractors to disclose to their customers the name and address of any subcontractors involved in the project. Failure to do so is a violation of the consumer protection act.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT requiring building contractors to disclose the name of any subcontractors involved in the project.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Chapter; Regulation of Building Contractors. Amend RSA by inserting after chapter 359-F the following new chapter:

CHAPTER 359-G

REGULATION OF BUILDING CONTRACTORS

359-G:1 Use of Subcontractors. A building contractor shall disclose to the customer or recipient of the contractor's services the name, address, and telephone number of any subcontractor that the contractor uses in performance of the contract. Before a building contractor uses a subcontractor, the customer or recipient of the contractor's services shall consent, in writing, to the use of the subcontractor's services.

359-G:2 Remedy.

I. Any violation of this chapter is an unfair or deceptive act or practice within the meaning of RSA 358-A:2. Any right, remedy, or power set forth in RSA 358-A may be used to enforce the provisions of this chapter.

II. The rights, obligations, and remedies provided in this chapter shall be in addition to any other rights, obligations, or remedies provided for by law or in equity.

2 Effective Date. This act shall take effect January 1, 2004.
