STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT making placement of political advertising on public property subject to state litter laws.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Litter Control Law; Definition. Amend RSA 163-B:2 to read as follows:
163-B:2 [Definitions] Definition. As used in this chapter, unless the context clearly requires otherwise, the [following words or phrases shall have the following meanings:
I. The] word "litter" means all rubbish, refuse, garbage, trash, debris, political advertising as defined in RSA 664:2, VI placed on public property, dead animals, or other discarded materials of every kind and description.
2 Fish and Game; Littering, Penalty. Amend RSA 207:36-b, I to read as follows:
I. No person shall put, place, or leave, or cause to be put, placed, or left, in or upon any way, public property, private property, into or on the ice over any public water, or into or on any waters of the state, any bottles, glass, crockery, cans, scrap metal, junk, paper, political advertising as defined in RSA 664:2, VI, garbage, old automobile or parts thereof, or refuse of any nature whatsoever, or any noxious thing.
3 Rules of the Road; Littering, Penalty. Amend RSA 265:102, I to read as follows:
I. No person shall put or place, or cause to be put or placed, in or upon any way, right-of-way, street, square, lane, alley, public bathing place or the approaches thereto, or into or on the ice over any public water, streams, or watercourse or the approaches thereto or land bordering the same, or other public place in any city or town any bottles, glass, crockery, cans, scrap metal, junk, paper, political advertising as defined in RSA 664:2, VI, garbage, old automobile or parts thereof, or refuse of any nature whatsoever or any noxious thing; provided that nothing herein shall be construed as affecting authorized collections of such articles as garbage or refuse.
4 Water Pollution and Waste Disposal; Penalties. Amend RSA 485-A:15, I to read as follows:
I. It shall be unlawful for any person to put or place, or cause to be put or placed into a surface water of the state or on the ice over such waters, or on the banks of such waters, any bottles, glass, crockery, cans, scrap metal, junk, paper, political advertising as defined in RSA 664:2, VI, garbage, tires, old automobiles or parts thereof, trees, or similar litter.
5 Effective Date. This act shall take effect January 1, 2004.

HB 695 FISCAL NOTE
AN ACT making placement of political advertising on public property subject to state litter laws.
FISCAL IMPACT:
The Departments of Transportation, Fish and Game, and Environmental Services state this bill will have no fiscal impact on state, county, and local revenue or expenditures.
METHODOLOGY:
The Departments state this bill would have no fiscal impact on state, county, and local governments. The addition of political advertising on public property subject to state litter law can be enforced with existing staff within existing budgets.
