STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
A RESOLUTION concerning misdemeanors and probable cause.
Whereas, the general court and the governor do hereby concur and reaffirm that misdemeanor offenses of any kind shall not constitute probable cause under the Fourth Amendment of the United States Constitution; and
Whereas, the scope and power of the federal government, especially under the USA Patriot Act, should be limited in order to protect and preserve the liberty and freedom of the citizens of this state; and
Whereas, any interpretation to the contrary is hereby deemed to be unjust and incorrect; now, therefore, be it
Resolved by the Senate and House of Representatives in General Court convened:
That the general court and the governor do hereby concur and reaffirm that misdemeanor offenses of any kind shall not constitute probable cause under the Fourth Amendment of the United States Constitution.
