STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT relative to motor vehicle fees.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Motor Vehicles; Certificates of Title and Registration of Vehicles; Registration Fees; Fees to be Collected; Prorated Fees for Motor Vehicles. Amend RSA 261:141, III(g) to read as follows:

(g) For all motor vehicles other than those in RSA 261:141, I:

0-3000 lbs. [$25.20 ($2.10] $27.60 ($2.30 per month)

3001-5000 lbs. [$37.20 ($3.10] $39.60 ($3.30 per month)

5001-8000 lbs. [$49.20 ($4.10] $51.60 ($4.30 per month)

8001-73,280 lbs. $ .84 per hundred lbs. gross weight.

2 New Paragraphs; Emission Control Equipment; On-Board Diagnostic and Vehicle Safety Inspection Program. Amend RSA 266:59-b by inserting after paragraph IV the following new paragraphs:

V. The director shall, with the approval of the commissioner, adopt rules pursuant to RSA 541-A relative to:

(a) The efficient administration of this section.

(b) Reasonable fees to cover the operation of an approved electronic on-board diagnostic and vehicle safety inspection program. All fees collected pursuant to this subparagraph shall be deposited in the highway fund.

VI. The department of safety shall submit an annual report, beginning on July 1, 2004, to the speaker of the house of representatives, the president of the senate, and the governor and council which shall include, but not be limited to, a description of inspection services offered by the electronic on-board diagnostic and vehicle safety inspection program, the development of the technological advancements in division programs related to the vehicle safety inspection process, the revenue generated from the fees established in RSA 266:59-b, V(b), the degree of coordination with vehicle inspection stations, and the extent to which the vehicle inspection safety program is enhanced.

3 Appropriation. The sum of $925,859 for the fiscal year ending June 30, 2004 and $999,479 for the fiscal year ending June 30, 2005 are hereby appropriated to the department of safety for the purpose of funding the expenses of operating the electronic on-board diagnostic and vehicle safety inspection program established pursuant to RSA 266:59-b. Said appropriations shall be a charge against the highway fund to be expended as follows:

II. Three full-time highway patrol officers, at labor grade 19, for the fiscal year ending June 30, 2005.

III. One program specialist II, at labor grade 21, for the fiscal year ending June 30, 2004.

IV. One auditor II, at labor grade 21, for the fiscal year ending June 30, 2004.

V. Two secretaries II, at labor grade 9, for the fiscal year ending June 30, 2004.

5 Effective Date. This act shall take effect July 1, 2003.

SB 222 FISCAL NOTE

AN ACT relative to motor vehicle fees.

FISCAL IMPACT:

The Department of Safety states this bill, as amended by the Senate (Senate Amendment #2003-1086s), will increase state highway fund revenue by $2,400,000 in FY 2004 and each year thereafter, increase state highway fund expenditures by $925,859 in FY 2004, $1,287,479 in FY 2005, $1,141,732 in FY 2006, and $1,452,507 in FY 2007, and increase local revenues by $288,000 in FY 2005 and each year thereafter. There will be no fiscal impact on county revenue or county and local expenditures.

This bill appropriates $925,859 and $999,479 from the highway fund to the Department of Safety in FY 2004 and FY 2005, respectively.

METHODOLOGY:

The Department stated this bill increases registration fees for motor vehicles and inserts provisions for the administration of the electronic on-board diagnostic and vehicle safety inspection program. The registration fee will increase by $2.40 annually per vehicle, which will result in additional highway fund revenue of $2,400,000 per year based on an estimated one million vehicles. As required by RSA 235:23, 12% of any additional highway fund revenue will be distributed to locals the following fiscal year, which will result in an increase of highway expenditures and local revenue of $288,000. This bill also provides for one Program Specialist (LG 21) position, nine Highway Patrol Officer positions (LG 19), one Auditor position (LG 21), two Secretary positions (LG 9), and associated costs for the purpose of operating the electronic on-board diagnostic and vehicle safety inspection program. This bill appropriates $925,859 in FY 2004 and $999,479 in FY 2005 from the highway fund for this purpose. The estimated fiscal impact on highway fund expenditures is as follows:
