SENATE BILL 337

AN ACT relative to the regulation of traps by the fish and game department and relative to the liability of trappers for certain injuries to domestic animals.

AMENDED ANALYSIS

This bill repeals a provision of law restricting certain traps. This bill also excludes trappers from liability for injuries to dogs running at large and requires reporting of injuries to licensed dogs.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Four

AN ACT relative to the regulation of traps by the fish and game department and relative to the liability of trappers for certain injuries to domestic animals.

Be it Enacted by the Senate and House of Representatives in General Court convened:

65:1 Damage to Domestic Animals; Dogs Running at Large Excepted. Amend RSA 210:18 to read as follows:

210:18 Damage to Domestic Animals. Any person causing injury or damage to domestic animals, except for dogs at large pursuant to RSA 466:33, by the aid or use of traps shall be liable to the owner therefor. An injury to a licensed dog at large shall be reported to the town or city listed on the dog’s tag, and to the owner of the dog if identifiable.

65:2 Repeal. RSA 210:11-a, relative to restrictions on certain traps, is repealed.

65:3 Effective Date. This act shall take effect 60 days after its passage.
