SENATE BILL 344
AN ACT relative to the use of gifts and donations to the fish and game department and relative to off highway recreational vehicle fees.
ANALYSIS
This bill establishes an account for gifts and donations to the fish and game department. This bill also changes fees for OHRV transfers of registration and agents’ accounting to conform to related provisions in current law.
This bill is a request of the fish and game department.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Four
AN ACT relative to the use of gifts and donations to the fish and game department and relative to off highway recreational vehicle fees.
Be it Enacted by the Senate and House of Representatives in General Court convened:
149:1 Fish and Game Fund; Account for Gifts and Donations. RSA 206:33-a is repealed and reenacted to read as follows:
206:33-a Gifts and Donations; Account Established.
I. Notwithstanding any other provision of law to the contrary, individual gifts and donations not exceeding $2,500 in value in a year may be received by the fish and game department with the consent of the commission and without the approval of the governor or the governor and council. Individual gifts and donations exceeding $2,500 in value in a year may be received by the fish and game department with the consent of the commission and with the approval of the governor and council.
II. There is established an account within the fish and game fund to be known as the gifts and donations account. Moneys in the gifts and donations account are nonlapsing and continually appropriated to the fish and game department. All gifts and donations shall be deposited in this account, except gifts and donations made to the department in support of a specific program that has an established dedicated account in title XVIII which shall be deposited into the appropriate
dedicated account and expended in accordance with the purpose of the dedicated account.
149:2 OHRV; Fee for Transfer of Registration. Amend RSA 215-A:22, I to read as follows:
I. A person who conveys to another the ownership of his registered OHRV may register in his name another OHRV for the remainder of that registration year, at a reduced rate of [$4] $13, provided that the reverse side of the registration form is completely filled out and submitted to a registration agent upon request for transfer.
149:3 OHRV Agent’s Accounting Fee. Amend RSA 215-A:24-a, I to read as follows:
I. The agent shall collect from the applicant a fee of [$1] $2 for each OHRV registration issued and shall account to the executive director for the full face value of the registration decals. He shall pay to the executive director no later than the fourteenth of each month the full face value of all registrations sold up to the first of the same month and shall report the names and addresses of all persons to whom registration decals have been sold and such other information as may be requested on blanks to be furnished by the OHRV registration office.
149:4 New Subparagraph; State Treasurer; Application of Receipts. Amend RSA 6:12, I(b) by inserting after subparagraph (227) the following new subparagraph:
(228) Moneys deposited in the fish and game department gifts and donations account under RSA 206:33-a.
149:5 Effective Date. This act shall take effect 60 days after its passage.
