AN ACT relative to damage to land by certain recreational uses.

This bill limits liability of landowners who allow OHRVs to use their property, when OHRV operators fill or dredge a wetland without a permit.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Four
AN ACT relative to damage to land by certain recreational uses.
Be it Enacted by the Senate and House of Representatives in General Court convened:
122:1 New Paragraph; Limited Landowner Liability. Amend RSA 482-A:14-b by inserting after paragraph II the following new paragraph:
III. A landowner shall not be liable for violations of this chapter caused by persons operating OHRVs, as defined in RSA 215-A:1, V, in a location or in a manner not authorized by the landowner.
122:2 Effective Date. This act shall take effect upon its passage.
