SENATE BILL 396-FN
AN ACT relative to farm tractor registrations.
ANALYSIS
This bill clarifies which all terrain vehicles qualify for farm tractor registration. This bill also prohibits driving an all terrain vehicle with a farm tractor registration on class I or class IV highways.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Four
AN ACT relative to farm tractor registrations.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Motor Vehicles; Words and Phrases Defined; Tractor. Amend RSA 259:108 to read as follows:
259:108 Tractor. "Tractor" shall mean any self-propelled vehicle designed or used as a traveling power plant or for drawing other vehicles, but having no provision for carrying a load, but shall not include off-highway recreational vehicles not designed and equipped for highway use. For purposes of this definition, an all terrain vehicle equipped with dual headlights, dual taillights, and any equipment required by RSA 215-A is an off-highway recreational vehicle designed and equipped for highway use.
2 Farm Tractor Plates; All Terrain Vehicles. Amend RSA 261:83, I to read as follows:
I. A tractor shall qualify for farm tractor registration rates and shall be driven with such registration only when the tractor is used exclusively for agricultural purposes or to draw another vehicle in such a way that part of the load is carried on such towing vehicle. An all terrain vehicle shall not be driven with a farm tractor registration on any class I or class IV highway.
3 Effective Date. This act shall take effect January 1, 2005.

SB 396 FISCAL NOTE
AN ACT relative to farm tractor registrations.
FISCAL IMPACT:
The Department of Safety has determined this bill will have no fiscal impact on state, county and local revenue or expenditures.
METHODOLOGY:
The Department stated this bill intends to clarify which ATV's qualify for farm tractor registration, and driving ATV's with farm tractor registrations will be prohibited on highways.
