STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Four
AN ACT relative to residency requirements for Medicaid recipients in nursing homes.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Public Assistance; Eligibility for Assistance; Nursing Home Residency Requirement. Amend RSA 167:4 by inserting after paragraph IV the following new paragraph:
V. No person living in a nursing home in New Hampshire shall be eligible for participation in the state Medicaid program unless the person meets the residency requirements for medical assistance under the state plan. In no event shall the words "resident" or "residency" be construed less restrictively than as provided in 42 C.F.R. 435.403.
2 Effective Date. This act shall take effect 60 days after its passage.
