STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Four

AN ACT relative to confidentiality and workers’ compensation.

Be it Enacted by the Senate and House of Representatives in General Court convened:

223:1 Records of the Department of Labor; Workers’ Compensation. Amend RSA 273:5 to read as follows:

273:5 Records.

I. The records of [said] the department of labor shall be public records open to the inspection of any person interested.

II. Notwithstanding paragraph I or any other provision of law to the contrary, the department of labor shall maintain the confidentiality of the names, addresses, and medical records of workers’ compensation claimants and the worker’s “First Report of Injury” filed with the department.

223:2 Effective Date. This act shall take effect upon its passage.
