SENATE BILL 437
AN ACT relative to unemployment compensation.
ANALYSIS
This bill includes corporate entities as evidence to be used by the commissioner to exclude services by individuals from being deemed employment for unemployment compensation.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Four
AN ACT relative to unemployment compensation.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Definitions. Amend RSA 282-A:9, III(b)-(c) to read as follows:
(b) Such service is either outside the usual course of the business for which such service is performed or that such service is performed outside of all the places of business of the enterprise for which such service is performed; [and]
(c) Such individual is customarily engaged in an independently established trade, occupation, profession, or business; and
(d) Such individual is an independent contractor operating as a corporate entity.
2 Effective Date. This act shall take effect 60 days after its passage.
