SENATE BILL 472
AN ACT relative to updating the terminology in statutes affecting children with special health care needs.
ANALYSIS
This bill revises state statutes to replace the term "crippled children" with the term "children with special health care needs" and defines the term consistently with applicable federal law.
This bill is a request of the department of health and human services.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Four
AN ACT relative to updating the terminology in statutes affecting children with special health care needs.
Be it Enacted by the Senate and House of Representatives in General Court convened:
21:1 Protection for Maternity and Infancy; Children With Special Health Care Needs. Amend RSA 132:13 to read as follows:
132:13 [Crippled] Children With Special Health Care Needs.
I. Services provided for [crippled] children with special health care needs in accordance with RSA 132:2, X, shall include location, diagnoses, hospitalization, medical, surgical, corrective, and other services and care of such children.
II. In this chapter, "children with special health care needs" means children who have or are at risk for chronic physical, developmental, behavioral, or emotional conditions and who also require health and related services of a type or amount beyond that required by children generally.
21:2 Protection for Maternity and Infancy; Subdivision Heading Amended. Amend the subdivision heading preceding RSA 132:11 to read as follows:
Maternal, Child Health, and [Crippled Children] Services
for Children With Special Health Care Needs
21:3 Protection for Maternity and Infancy; Purpose; References Changed. Amend RSA 132:1 to read as follows:
132:1 Purpose; Instruction. The department of health and human services may provide instruction, advice and such services as the commissioner may deem necessary for [crippled] children with special health care needs, [for children suffering from crippling conditions,] and to protect and promote the physical health of women in their child-bearing years and their infants and children.
21:4 Reference Change; Replace the Term "Crippled Children" with "Children With Special Health Care Needs." Amend the following RSA provisions by replacing "crippled children" with "children with special health care needs": RSA 132:2, X and 132:10-b, IV.
21:5 Effective Date. This act shall take effect 60 days after its passage.
