STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Five
AN ACT relative to access to certain motor vehicle records.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Motor Vehicle Records; Access by Attorney in Criminal Case. Amend RSA 260:14 by inserting after paragraph III-a the following new paragraph:
III-b. An attorney of record for the defendant in a criminal case, and any of his or her staff members acting under the direction and supervision of counsel for the defense or any private investigator licensed under RSA 106-F who has been hired by counsel for the defense, shall be allowed to obtain any and all records of motor vehicle offenses and current address of any person who is a defendant, complainant or potential witness in the case. These records shall not be denied pursuant to Saf-C 5605.17.
2 Effective Date. This act shall take effect 60 days after its passage.
