AN ACT relative to reasonable accommodation by employers under the state law against discrimination.
ANALYSIS
This bill requires employers to provide reasonable accommodation, unless business necessity makes the accommodation impossible or imposes an undue hardship on the employer.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Five
AN ACT relative to reasonable accommodation by employers under the state law against discrimination.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Reasonable Accommodation. Amend RSA 354-A:7 by inserting after paragraph VI the following new paragraph:
VII.(a) For any employer not to make reasonable accommodations to the known physical or mental limitations of an otherwise qualified individual with a disability who is an applicant or employee, unless such employer can demonstrate that the accommodation would impose an undue hardship on the operation of the business of the employer; or
(b) For any employer to deny employment opportunities to a job applicant or employee who is an otherwise qualified individual with a disability, if such denial is based on the need of such employer to make reasonable accommodation to the physical or mental impairments of the applicant or employee.
2 Effective Date. This act shall take effect January 1, 2006.
