AN ACT relative to the authority of the Carroll county public water system.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to the authority of the Carroll county public water system.

Be it Enacted by the Senate and House of Representatives in General Court convened:

17:1 New Paragraph; Authority for the County of Carroll to Operate and Maintain a Public Water System; Water Fund Added. Amend 2002, 174:5 by inserting after paragraph IV the following new paragraph:

IV-a. The funds received from the collection of water rates shall be kept as a separate and distinct fund to be known as the water fund. Such fund shall be allowed to accumulate from year to year, shall not be commingled or deemed part of the Carroll county general fund accumulated surplus. Such fund may be expended only for the purposes specified in RSA 38:28, or for the previous expansion or replacement of water lines or water systems. All water funds shall be held in the custody of the Carroll county treasurer. Estimates of anticipated water rate revenues and anticipated expenditures from the water fund shall be prepared and submitted to the county commissioners, and shall be included as part of the county budget submitted to the county convention for approval. Expenditures shall be within amounts appropriated by the county convention.

17:2 Effective Date. This act shall take effect 60 days after its passage.
