HOUSE BILL 1494

AN ACT relative to public use of groundwater.

ANALYSIS

This bill requires the department of environmental services to give municipal water supplies primacy in the use of groundwater that is wholly or partially within the jurisdiction of the municipality when the department is making any decision or issuing any permit under the groundwater protection act.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to public use of groundwater.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Duties of the Department; Municipal Water Supplies. Amend RSA 485-C:3 by inserting after paragraph V the following new paragraph:

VI. Give municipal water supplies primacy in the use of groundwater wholly or partially within the jurisdiction of the municipality when it makes any decision or issues any permit under this chapter.

2 Effective Date. This act shall take effect 60 days after its passage.
