AN ACT relative to certain insurance claims.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Six
AN ACT relative to certain insurance claims.
Be it Enacted by the Senate and House of Representatives in General Court convened:
104:1 Individual Health Care Insurance; Retroactive Denials. Amend RSA 415:6-i, II(b)(5) to read as follows:
(5) The claim payment is the subject of an adjustment with [another] a different insurer, administrator, or payor and such adjustment is not affected by a contractual relationship, association, or affiliation involving claims payment, processing, or pricing; or
104:2 Group Health Insurance; Retroactive Denials. Amend RSA 415:18-m, II(b)(5) to read as follows:
(5) The claim payment is the subject of an adjustment with [another] a different insurer, administrator, or payor and such adjustment is not affected by a contractual relationship, association, or affiliation involving claims payment, processing, or pricing; or
104:3 Health Service Corporations; Retroactive Denials. Amend RSA 420-A:17-e, II(b)(5) to read as follows:
(5) The claim payment is the subject of an adjustment with [another] a different insurer, administrator, or payor and such adjustment is not affected by a contractual relationship, association, or affiliation involving claims payment, processing, or pricing; or
104:4 Managed Care; Retroactive Denials. Amend RSA 420-J:8-b, II(b)(5) to read as follows:
(5) The claim payment is the subject of an adjustment with [another] a different insurer, administrator, or payor and such adjustment is not affected by a contractual relationship, association, or affiliation involving claims payment, processing, or pricing; or
104:5 Effective Date. This act shall take effect 90 days after its passage.
